Special Hearing to determine whether, pursuant to BCZR, Section 103.1, the provisions of BCZR (1955, as amended) Section 1B01.2.B.1 (Residential Transition Area) apply in this matter, and if they do not apply, then to approve the use of the property as a synagogue as shown on the Plan to accompany Zoning Hearing. If the ALJ determines that the BCZR (1955, as amended), Section 1B01.1.B.1 applies in this matter, then, to approve the site plan for the proposed synagogue in accordance with BCZR, Section 1B01.1.B.1.g(6), including a finding that restrictions of BCZR, Section 1B01.1.B.1.e(1) through (5) do not apply. To approve a modified parking plan pursuant to BCZR, Section 409.12.B to allow 2 parking spaces to serve the proposed synagogue in lieu of 20 spaces required. For such further and other relief as the nature of this case may require. Variance BCZR, Section 1B01.2.C.1.a for an existing front yard setback of 26 ft. in lieu of 40 ft. required, an existing interior side yard setback of 11 ft. in lieu of 20 ft. required, and an existing corner side yard setback of 28 ft. in lieu of 35 ft. required; no new building is proposed. From BCZR, Sec6tion 301.1 for an existing carport with a front yard setback of 25 ft. in lieu of the 30 ft. required and a side yard setback of 5 ft. in lieu of 15 ft. required; no new building is proposed.
